“We give the impression of hamsters on a wheel,” magistrates and court clerks lament.

More violence, less damage to property and justice professionals in the “loss of meaning” of their mission. Here is the (very) general plan for the activities of the Judicial Court of Pau in 2021. More violence, less damage to property and justice professionals in the “loss of meaning” of their mission. Here is the (very) general plan for the activities of the Judicial Court of Pau in 2021. Due to the health crisis, the return-to-school solemn hearing was held behind closed doors. The magistrates and clerks delivered their inventories to the press.

1 Eighteen months of civil detention

“From a civil justice point of view, we managed to cope with the delay that occurred during the conclusion,” said the President of the Judicial Court, Poe Jean-Pierre Boucher. The stock of processed files has decreased. But the delays are too long. In a case between two citizens, for example in a construction case, eighteen months elapse between the imposition of an arrest and the issuance of a decision.

As far as criminal penalties are concerned, the time limits for some procedures are much shorter. They have two months to appear on a preliminary confession of guilt, the French “pleaded guilty.” For a criminal court that hears wrongdoing, it takes an average of seven months between the filing of a summons and the date of the hearing.

2 More violence against people

In 2021, property damage is decreasing, but online fraud is on the rise. Violence against others and in particular within the family is also on the rise, prosecutor Cecile Jensac said. The dissemination of serious facts leads to the fact that more cases are referred to the investigating judges. In 2019, there were 106 new cases on their desk. There were 168 in 2020 and 149 in 2021. Cases that mostly end in criminal court. You will have to absorb them. In a context where magistrates wish to limit late hearings, delays should increase.

2 Shortage of clerks and staff

Court Po is no exception to this national trend: the lack of clerks. These precious hands of justice fail jurisdiction. There should be 77 of these officials. But in 2021, this figure is actually lower by 18.8%. Doubtful, vacancies and stops. “We have requests for secondment of clerks to other administrations where they are paid no less, but with less restrictions. This is unprecedented,” says Jean-Pierre Boucher.

There are also not enough judges. “In France, we have just over ten magistrates per 100,000 inhabitants,” recalls Jean-Pierre Boucher. The European average is 17 magistrates. For us, this is a dream. »

On the prosecution side, the situation is hardly more enviable. Remember that these judges are the first to be captured after the facts. They direct the answer to be given. “We have been asking for a seventh post for the Poe prosecution for many years,” prosecutor Cecile Jensac said. True, reinforcements were sent to contract positions such as paralegals. “But support only works when there are funds,” explains Cécile Jensac. These resources were invested in new and narrowly focused missions. For example, when a prosecutor’s representative quickly receives and explains criminal cases, this removes conflicts. But this does not exempt magistrates and clerks. They do not replace either one or the other.

3 Heavy weight to carry

Result ? The scales of justice are very heavy. The prosecutor assures him: “There is great suffering at work. We ensure that our core missions such as the hearings, but others remain in the backpack. It could be mail flow, partnership projects to prevent relapse. All this prevents the magistrates from receiving the award. The meaning of the work is completely lost. We feel like a hamster spinning on a wheel. At some point, we are out of breath. “Jean-Pierre Boucher agrees: “All magistrates and clerks feel they are doing a bad job. They lose the meaning of their mission.”

5 New setting in Mercy

The Miséricorde building, located next to the Labarrère media library, will house several judicial services: the civil and social pole, the Labor Court and the commercial court. The building is to be handed over in April for occupancy at the end of August and start of activity at the beginning of September. The Palace of Justice will continue to house the criminal court and the juvenile court. Its construction will be the subject of work from September. It will be renovated.
